मेरी माँ ने अप्रैल 1985 में मुंबई में अपने नाम पर एक फ्लैट खरीदा था, अक्टूबर 2024 में उनका निधन हो गया। मैंने और मेरी बड़ी बहन ने अब फ्लैट को अपने नाम पर संयुक्त रूप से स्थानांतरित कर दिया है (हम दोनों अब NRI हैं)। अगर हम इस फ्लैट को अभी बेचना चाहते हैं तो टैक्स के क्या निहितार्थ होंगे? कम टैक्स के साथ बेचने का सबसे अच्छा तरीका क्या है?

Ans: चूंकि इसे अक्टूबर 2024 या उसके बाद में स्थानांतरित किया जाता है, इसलिए यदि आप इसे अपने नाम पर स्थानांतरण की तिथि से 2 वर्ष से पहले बेचते हैं, तो यह अल्पकालिक पूंजीगत लाभ होगा और आपको किसी भी पूंजीगत लाभ छूट की अनुमति नहीं दी जाएगी। आप केवल दीर्घकालिक पूंजीगत लाभ पर छूट के लिए पात्र होंगे, इसलिए आपको अपने नाम पर फ्लैट के हस्तांतरण की तिथि के 2 वर्ष बाद फ्लैट बेचना होगा।
