नमस्ते सर मेरे ससुर अपनी आवासीय संपत्ति मेरी पत्नी के नाम पर हस्तांतरित करना चाहते हैं। वसीयत के अलावा और कौन से तरीके हैं जिनसे वह इसे हस्तांतरित कर सकते हैं? और कराधान घटक क्या होगा?

Ans: उपहार के अलावा, वह अपनी संपत्ति को हस्तांतरण/बिक्री विलेख के माध्यम से अपनी बेटी को हस्तांतरित कर सकता है। पंजाब जैसे कई राज्यों में, बिना किसी पंजीकरण शुल्क के भुगतान के, परिवार के भीतर संपत्ति हस्तांतरित की जा सकती है। ऐसे लेन-देन में आयकर शामिल नहीं है। किसी भी अन्य स्पष्टीकरण के लिए आपका स्वागत है। धन्यवाद।

संपत्ति महाराष्ट्र में स्थित है। वह अपनी बेटी को संपत्ति उपहार में देना चाहता है। उपहार विलेख प्रक्रिया क्या है और उस पर क्या शुल्क/कर लागू होते हैं?

Ans: 01. गिफ्ट डीड में डोनर (नाम, आयु, आधार और पैन नंबर, पता इत्यादि) और डोनर का पूरा विवरण होना चाहिए। दोनों को डीड पर हस्ताक्षर करना चाहिए। इस पर कम से कम दो गवाहों के हस्ताक्षर होने चाहिए।

02. महाराष्ट्र में स्टाम्प ड्यूटी संपत्ति के मूल्य का लगभग 3% (परिवार के सदस्यों के मामले में) लगती है। इसके अलावा, आपको पंजीकरण शुल्क के रूप में 1% का भुगतान करना पड़ सकता है।
