मैंने जुलाई 2018 में 15.00 लाख रुपये में एक जमीन का प्लॉट खरीदा, फिर मैंने उसी वर्ष उस पर एक घर बनाया, जिसकी लागत 40.00 लाख रुपये थी। मार्च 2021 में मैंने पूरी संपत्ति 98.50 लाख रुपये में बेच दी और अपने वयस्क बच्चों के नाम पर 65.00 लाख रुपये मूल्य की सेब के बागानों वाली जमीन खरीदी। कृपया सूचित करें कि क्या मैं या मेरा कोई बच्चा किसी कर भुगतान के लिए उत्तरदायी है। यदि हाँ, तो क्या कर छूट का कोई तरीका है।</p>

Ans: चूंकि प्लॉट+घर मार्च 2021 में बेचा गया है, इसलिए इसे लॉन्ग टर्म कैपिटल गेन माना जाएगा क्योंकि संपत्ति रखने की अवधि 2 साल (24 महीने) से अधिक है।</p> <p>यदि आवासीय संपत्ति की बिक्री से दीर्घकालिक पूंजीगत लाभ (LTCG) को कृषि भूमि में पुनः निवेश किया जाता है, तो छूट उपलब्ध नहीं है।</p> <p>आप भारत में स्थित एक नई आवासीय संपत्ति (घर, न कि सिर्फ जमीन) में पूंजीगत लाभ को पुरानी संपत्ति (यदि घर है) की बिक्री की तारीख से 1 साल पहले या 2 साल के भीतर फिर से निवेश करके एलटीसीजी पर छूट का दावा कर सकते हैं। अधिग्रहण किया गया है) या 3 साल के भीतर (यदि घर का निर्माण किया गया है)। आप शर्तों के अधीन अधिकतम 50 लाख की राशि के लिए 54EC बांड में भी निवेश कर सकते हैं।</p> <p>इस मामले में, चूंकि आपने बिक्री से प्राप्त राशि को कृषि भूमि में निवेश किया है, इसलिए LTCG पर इंडेक्सेशन के साथ 20% कर लगेगा।</p>

ग्रामीण क्षेत्र में कृषि भूमि 2019 में 17 लाख रुपये (50-50 भागीदारी में) में खरीदी गई, 2025 मार्च में 20 लाख रुपये में बेची गई। मैं इस राशि को MF और इक्विटी में निवेश करना चाहता हूँ। बेची गई भूमि पर कर देयताएँ क्या होंगी? आयकर (10 लाख-8.5 लाख = 1.5 लाख) पर लगेगा या 10 लाख पर। कृपया सलाह दें।
Ans: ग्रामीण कृषि भूमि की बिक्री पर कर निहितार्थ
ग्रामीण कृषि भूमि को भारत में पूंजीगत संपत्ति नहीं माना जाता है।

इसलिए, ऐसी भूमि की बिक्री से होने वाले किसी भी लाभ पर कर नहीं लगता है।

यह छूट बिक्री से होने वाले लाभ की परवाह किए बिना लागू होती है।

ग्रामीण कृषि भूमि की बिक्री से होने वाला लाभ पूरी तरह से कर-मुक्त है।

आपके मामले में कृषि भूमि की बिक्री
आपने 2019 में 50-50 की भागीदारी के साथ 17 लाख रुपये में जमीन खरीदी थी।

मार्च 2025 में जमीन 20 लाख रुपये में बेची गई, जिससे 3 लाख रुपये का लाभ हुआ।

बिक्री से होने वाली आय में आपका हिस्सा 10 लाख रुपये है।

चूंकि भूमि ग्रामीण कृषि भूमि के रूप में योग्य है, इसलिए बिक्री से होने वाला लाभ कर से मुक्त है।

Hello Sir, I asked my another question couple of months back but somehow now its disappeared. I wanted to know more in details that if I dont incur any expenses on sale of agriculture land (like road, sewer, electricity, park etc.) in plots then what are my options. e.g. I purchased agriculture land in Rs. 40 Lacs in 2019 & total sum I received 1 Cr. in different small plots sale during 2024-25 & 2025-26 & I purchased another plot (or a house) in residential colony of 80 Lacs in 2025-26 then is there any tax liability on me in any of F.Y. where I sold plots? If yes then how much tax & in which year? Thanks
Ans: Yes, there can be tax liability, depending on how the transaction is treated:

If treated as Capital Gains (land held as investment, no development done):

Land held since 2019, so Long-Term Capital Gain (LTCG) applies.

Sale Amount: Rs. 1 crore (in F.Y. 2024–25 and 2025–26)

Purchase Price: Rs. 40 lakh (indexed)

Capital Gains: Rs. 60 lakh (approx., after indexation)

If you buy a residential house (not just a plot) worth Rs. 80 lakh in 2025–26:
You can claim full exemption under Section 54F, since all sale proceeds are reinvested.

No tax liability in that case.

If you only buy a residential plot (without constructing a house within 3 years):
No exemption under Section 54F.
You will pay 20% LTCG tax on indexed gains in proportion to sale in each year.

E.g.,

If Rs. 50 lakh was received in 2024–25 → LTCG tax applies in that year.

If Rs. 50 lakh was received in 2025–26 → tax applies in that year.

Please note:
Buying only a plot won’t save tax. You must construct a house within 3 years for exemption.
