It is reg LTCG on sale of property acquired through Gift Deed from Mom. Residential house acquired through Will by my Grandmother in 2004, who gifted the same to my Mom in 2006 and my Mom gifted the same to me in 2021. Both Gift deeds are registered. I sold the property after 18 months of getting gift. My querries are (1) What will be the Capital Gain, STCG or LTCG and (2) what will be the my cost for calculating capital gain.

Ans: In case of gift, date of acquisition and cost will be of the previous owner. Thus, in my view, date of acquisition and cost will be of original owner who spent money in acquiring the asset. If original owner acquired before 1.4.2001, FMV as on 1.4.2001 will be cost.

My brother purchased a piece of land in Assam in October 1983 which he gifted me by a deed in August 2010. I sold the same piece of land in March 2024. The stamp duty fair price is about Rs 1,40,00,000. Will this transaction attract Capital Gain Tax? How can I myself calculate the LTCG if such a situation presents itself?
