Hello Sir, Good day ! I work for a Bangalore based KPO. In my company few teams got dissolved as clients projects got over. I am a male working in night shifts from last 9 years and 34 years old. We are on bench right now. My manager is forcing us to do night shift and rather relocate to another city. I have some family emergency that is coming up and i am settled in Bangalore. Few other team members those were on bench got call same day in which my boss and HR was there. They gave two options to them 1. Put resignation take 3 months salary. (We have 3 months notice period ) If not they will get terminated with no experience certificate and blacklisted also. Is there any law that can safe guard me. Please advise right course of action and what shouls be the right way of deali g with that

Ans: Dear

my suggestion don't even think of the legal way, it will distract and drain your energy.

Try talking to your company about your emergency and seek time, if they give great, if they don't then suggest you take up what they are offering or look for alternate job.

All the best

Warm Regards

Hello Sir, Don't disclose my name, I am working in boarding school from last 2 year's, last year principal changed and he is giving lot of work (harassing staff ) so around 50% of staff left the school. he is not appointing new staff also. hardly 2-3 staff he has appointed. In my department 3 staff ware there now I am alone, he is not appointing any one, so I am alone handling all the classes. he has increased the work also. So I decided to leave the work and I got the work also. I have sent my resignation letter through mail. In my appointment letter they have mentioned “During the probation period your service may be terminated by ONE MONTH NOTICE on “either side or Salary in lieu of notice” and The relieving date in all circumstances will not be earlier than the last day of the academic year unless the school terminates. if you are working on any assignment when you tender your resignation such assignment must be completed to the satisfaction of the school before your services will be released. As allocation of subject teaching is a duty allocated for the academic year the reliving date will not be earlier than the last date of the academic year in which the resignation is tender. The school does not encourage mid term session dis continuation of services. School academic year will ends in April. At the time of appointment they have taken all my original certificates. But when I sent my resignation with one month notice period they replied as per your request, you will be relived after the completion of required formalities and work as per service rules. But, yet they are not mentioning what are the work to complete. After one month notice period immediately I have to join my new job. otherwise i will miss my opportunity. orally simply they are extending my date. At present they have extended 15 days after my last day of my notice period. kindly guide me how to solve the problem, get back my originals and join my new job smoothly. Regards
Ans: Please consult a lawyer

Hi sir I could not serve my 3 months notice period however I had served 2 months and asked HR to give me early reliving. I mentioned that my parents are not well and attached medical prescription but they denied and said you to serve complete 3 months. After 2 months I stopped going to office they were sending me absconding mails meanwhile and after 1month they sent me termination letter what shall I do In such case ? I was working there for 2 years.
Ans: I’m sorry to hear about your situation. When facing termination due to not serving the full notice period, it’s important to understand your rights and the potential legal implications. Here’s what you can consider doing:

Review Your Employment Contract: Check the terms regarding the notice period and termination. There might be provisions for situations like medical emergencies.
Legal Consultation: It may be beneficial to consult with a labor law attorney who can provide advice based on the specifics of your case and the applicable laws.
Documentation: Gather all relevant documentation, including the medical prescriptions you submitted, any communication from HR, and the termination letter.
Negotiation: You could attempt to negotiate with your employer, explaining the situation with your parents and seeking a compassionate resolution.
Labor Office: If negotiation fails, you may approach the local labor office or labor court for guidance and to explore options for redressal.
Understand Legal Precedents: Familiarize yourself with any legal precedents that may apply to your case. For instance, the Supreme Court has provided judgments on employment notice periods that might offer insights into your rights and obligations.
Remember, each situation is unique, and the best course of action depends on the specifics of your employment contract and the company’s policies. It’s crucial to handle the matter professionally and legally to ensure the best possible outcome. Good luck!

It's understandable to feel frustrated and low after dedicating over two decades to your job, especially when you're contemplating resigning but feel constrained due to financial obligations like housing and gold loans. I would recommend that you to take some time to assess your current situation and explore all your options. Consider the reasons behind your frustration and dissatisfaction with your job. Are there specific aspects of your role or workplace environment that are contributing to your feelings of discontent? Understanding the root causes can help you make informed decisions about your next steps.

If you ultimately decide to resign from your current job, develop a plan for transitioning to a new phase of your career or life. Update your resume, network with professionals in your industry, and explore job opportunities that align with your skills, experience, and interests in banking, finance, consulting, and related fields.

Finally, prioritize self-care and well-being as you navigate this challenging period. Take time for activities that bring you joy and relaxation, such as hobbies, exercise, spending time with loved ones, or pursuing personal interests. Hi My daughter get 72 percentile in jee mains 1 i dont know what happened to her otherwise she is a good student scored 94% in her 10th boards ..if i will look for some private engineering college in india pls suggest i will go with pune or will look for management quota seat for csc from banglore. Pls suggest preference order of btech college in banglore
Ans: Hello Vandana.
Requesting you not to panic at this early stage. Let her appear for JEE session 2 and the state-level engineering entrance test. Let all the results out. You have ample time to think about the available options for engineering admission. At this stage, no need to think about management quota unless and until you want a particular branch in a particular college. Depending on her score in upcoming exams, she may get admission to reputed engineering either in Pune or Bengaluru
Here are some colleges in Bengaluru: (1) R.V. College of Engineering (RVCE) (2) B.M.S. College of Engineering (BMSCE) (3) M.S. Ramaiah Institute of Technology (MSRIT) (4) PES University (5) Bangalore Institute of Technology (BIT) (6) Dayananda Sagar College of Engineering (DSCE) (7) Sir M. Visvesvaraya Institute of Technology (SMVIT) (8) BMS Institute of Technology and Management (BMSIT&M) (9) Nitte Meenakshi Institute of Technology (NMIT) (10) RNS Institute of Technology (RNSIT)
Suggestion - Don't panic. Keep cool yourself. Ask your daughter to focus more on JEE 2nd attempt and state-level engineering entrance test.

If you are satisfied with the reply, pl follow me or else ask again without hesitation.
Thanks
Radheshyam
