मैं एक सीनियर सिटीजन हूँ और मुझे एफडीआर ब्याज, सीनियर सिटीजन सेविंग स्कीम ब्याज, शेयर लाभांश आदि से आय होती है। कुल मिलाकर सालाना लगभग 3.5 लाख रुपये। ITR 2 में शून्य कर का कर रिटर्न दाखिल करना। मेरा सवाल यह है कि अगर मुझे जुलाई में 3 लाख रुपये का शॉर्ट टर्म कैपिटल गेन होता है, तो क्या मुझे एडवांस टैक्स देना होगा? या, क्या मैं 15 मार्च, 2025 तक 15% की दर से पूरा टैक्स चुका सकता हूँ? हो सकता है कि मुझे चालू वर्ष में और भी एसटीसीजी देना पड़े, तो मैं कैसे भुगतान करूँ?

धन्यवाद सर। मुझे बस एक ही स्पष्टीकरण चाहिए कि क्या शेयरों की बिक्री के लिए स्टॉक डाइस व्यवसाय आय की श्रेणी में नहीं आती है। व्यवसाय आय की परिभाषा क्या है, सर?

Ans: शेयरों की बिक्री से होने वाला लाभ कई कारकों पर निर्भर करते हुए व्यावसायिक हो सकता है। 29.02.2016 दिनांकित एक आयकर परिपत्र संख्या 6/2016 इसके लिए मार्गदर्शन प्रदान करता है। यदि होल्डिंग की अवधि 12 महीने से अधिक है, तो आप तय कर सकते हैं कि आप इसे व्यावसायिक आय या पूंजीगत लाभ के रूप में दिखाना चाहते हैं। लेकिन यदि इसे 12 महीने से अधिक समय तक नहीं रखा जाता है, तो यह मात्रा, धन के स्रोत, आय के मुख्य शीर्षक आदि के आधार पर तय किया जाएगा।
