Sir, I have purchased shares some 15-20 years back, they have been demated earlier. I dont know(remember) the purchased price and date of purchase. If i sell the shares, how can i show the long term capital gain tax in I/TAX return?

Ans: It will difficult to calculate the capital gains if the purchase price is not available. Do not sell everything in the same financial year then you may be exempt and capital gains may be below 1 lacs. Again everything is on assumption.

I had redeemed all units of Mutual Funds in the month of January 2022 when Sensex was at its peak. Since more than 1 year has passed since the SIP installment started this comes under Long Term Capital gain. The long term capital gain is less then Rs 1 Lakh. As per Income tax rules these capital gains of up to Rs 1 lakh a year are tax-exempt. Do I still need to declare this amount while filing Income Tax returns for the financial year 2021-2022 or only if the long term capital gain is above Rs 1 lakh this amount needs to be declared while filing Income Tax returns for the financial year 2021-2022?

Ans: Even if your long term gain doesn’t exceed 1 lakh and there is no capital gain applicable for the sold mutual funds, you need to show this gains during the filing of FY2021-22 and claim an exemption up to Rs 1 lakh.

Hello Tejasbhai, How do I save Long term capital Gains earned out of profit from sale of shares.

Ans: You may invest in eligible start-ups or may invest in REC bonds or invest in residential property and also in NPS scheme or ELSS schemes. You can c/f the losses on shares sale for 8 years as well, in case of losses.

Dear Mihir I purchased shares 10 years back now not trading now my Long term capital gains more than 1lakh can i show not trading shares as loss.

Ans: Loss from shares can be claimed once shares are transferred from d-mat. Thus, loss from non tradable shares can not be claimed unless shares transferred from d-mat.

Hi Mihir, I have a long term capital gains from US stocks (RSU) sold on the event of company being sold, the sale happened in september 2022 and money is still in foreign etrade account, If I get money now in my Indian SB account, when is this capital gain tax to be paid and how can I save it.

Ans: Tax on gain arises on transfer of capital asset being shares is taxable in the year in which shares are transferred.

Capital gain tax can be saved by investing consideration in acquiring house property provided you don't have more than 1 house property on the date of transfer.

I am meber of EPFO, DEC 1995 TO MARCH 1999 , THEN BREAK & AGAIN JOIN TO EPFO FROM 8 FEB 2006 TILL TODAY, & I HAVE GOT UAN NUMBER FROM FEB 2006 BUT FROM DEC 95 TO MARCH 1999 , THERE WAS NO PROVISON FOR UAN NUMBER, THEN HOW CAN MY LAST SERVICE ADD WITH PRESNT UAN NUMBER

Ans: You may have physical PF slips, documents from your employer which provide details of your EPF account during 1995 to 1999. If you have these records then you can visit EPFO and furnish application to link(merge) this account with your current UAN. They may need a letter from your employer during that phase, attesting the facts about your EPF account.

Ans: Yes EPS pension is calculated based on average basic salary of previous 60 months and pensionable service period.

Based on a predetermined formula involving these two factors EPS pension is determined.

From 1991 to 2001, EPF was there but no details are available with me..Company is also closed...How I will get epf benefit from this company.From the service of 2001 to 2019, now co. is asking pf slips from the emplyees. Sir, I had lost my Job during Covid Pandemic in the year 2020 and I had recently got all of my EPFO credited in my account for the last 10 years 6 months.. The EPF was being maintained by the Company's trust. I had asked the respective manager about my EPS(Pension) then he said that they only maintained the EPF amount and the EPS is maintained by the EPFO. Sir Can you tell me how can I access my EPS fund? Do I need any documents or prerequisites from the Company I last worked with or the company which maintained my EPF? Please provide me all the relevant information about my EPS amount and how can I withdraw it.

Ans: Since you worked for more then 10 years EPFO may not allow you to withdraw EPS. Depending on your age 50/58 you may be eligible to receive pension through EPS. Get the scheme certificate from your employer regarding EPS contributions. Have an active UAN linked to your Aadhar & Bank account so that you file claim for receiving EPS pension thru your assigned EPF office.
