Sir, I am having question regarding LTA, Actually I had travelled with my family in month of March 2024. Now in company it not allowing me to accept LTA declaration due to its happened in previous FY. So is it possible to me to submit LTA directly while submitting the ITR?

Ans: Yes, you can do that while filing your ITR but ensure you have proper proofs and bills in place.

Dear Sir, I have missed to file my individual ITR filing for the Asst. Year 2021-22 (FY: 2020-21) having refund of TDS approximately Rs 25,000. Is there any way to file the delayed ITR for the year ended 31.03.2021 (AY: 2021-22)? If possible kindly advise how to file it.

Ans: You may file applications for condonation of delay in filing returns claiming refund as per provisions of Sec 119(2)(b) of the Income-tax Act. As per Circular 9/2015, the Principal Commissioners of Income-tax shall be vested with the powers of acceptance/rejection of such applications/claims.

The powers of acceptance/rejection of the application will be subject to conditions like verification of income/loss declared and/or refund claimed and case is of genuine hardship on merits.

Once your application is accepted and order is passed by Principal Commissioners of Income-tax u/s 119, you will be able to file Income Tax Return at www.incometax.gov.in (external link).

LTA amount is given by my company each year. Is that amount exempted over and above of taxed amount in the new tax regime? How to show it, can I show it accumulating 4 years amount in one year?My yearly salary is 14 Lakh approx. I fall in ITR 1.

Ans: Leave Travel Allowance deduction is not allowed under new tax regime.

Sir, my NRI daughter has taxable LTCG in FY 23-24 and no other income. I understand that she has to file ITR in Form 2. I also understand the Form 2 has already been notified. My question is whether she can file IT return now itself or after 31st March or does she have to wait for any other announcement?

Ans: Typically forms keep changing its better to file near July.

Sir, The income for AY24-25 is only LTCG from equity MFs and interest from FDs of two NBFCs. As such, ITR filing can be done on 1st April 24 itself but one of the NBFCs is yet to populate AIS with interest paid data which action may extend to June 24. As the interest paid data is available in Bank Ac, can I file the ITR now itself as I am in a hurry? There will be mismatch with AIS right now but by the month of June, it will be normal when they post the figures.

Ans: You can but it may be advisable if you wait till June in order to avoid any mismatch in AIS (which will open yourself to scrutiny).

Sir, NRI daughter had LTCG income in FY23-24 and IT returns was filed in ITR-2 as per rules. In FY24-25 there is no taxable income and there is no LTCG also. In such a case, filing may not be required but she would like to file just to keep the records straight. My query is which ITR form is to be used in this case? In case if ITR-2 is not required, is there anything wrong in using ITR-2 itself?

Ans: You may file ITR of your daughter in Form No ITR-2. Hope you won't face any problem in this connection.
