Can you clarify whether a person opting for the new tax regime (ie concessional or lower rates of tax) is eligible to claim the Rs 1 lakh exemption for long term capital gain on shares?

Ans: Yes, you can claim the exemption of Rs 1 lakh on long term capital gains under the new regime.

is LTCG (Exemption of 1Lac and lower Tax) and STCG lower tax on Listed Shares available in the new tax regime ?

Ans: LTCG and STCG on listed shares will be taxed on special rate. Thus, old and new tax regime slab rate will not be applicable.

Difference will be for rebate avialable u/s 87ARs. Tax Rebate of 25,000 or the amount of tax payable (whichever is lower) is available under new tax regime as per Budget proposal of FY 23 24 (if taxable income is less than 7 lacs).
For old tax regime it is same as earlier Rs 12,500/- (if taxable income is less than 5 lacs).

I'm a salaried person with CTC close to Rs. 40L & my investments are much above the exempted tax benefit. Which one will be beneficial for me, is the new tax regime or the old regime?

Ans: Person having taxable income around 40 lacs and take deduction less than 4.25 lacs from housing loan/80C/80D, can opt for new tax regime as new slab rate is likely to be beneficial as per budget proposed for FY 2023-24

Under the proposed new tax scheme, is the figure of Rs. 7 Lakhs inclusive of LTCG from sale of shares and mutual funds? Meaning, if one has regular income of 5,50,000 p.a. from pension, FD interest, etc and a capital gain of 1,50,000 from sale of equity - total amounting to Rs. 7 lakh, will his tax liability be nil or what will be his tax liability?

The rebate of tax under section 87A is on the total income that is taxable and hence even capital gain is included for that purpose
