am 56 yrs old and own a Flat on my single name in Jaipur. My wife also own a small flat on her single name in Greater Noida. We are planning to buy a flat in Gurgaon for self use after our retirement. The likely possession of the under constructed flat is after 4 years from today. If we both sell our flats and invest the complete amounts in our new flat on Joint name of Self and wife, can be both awail the benefits of capital gain exemption.

Ans: You would be entitled to exemption u/s 54, provided :
01. Purchased property is residential & in preferably, in joint names of both of you.
02. Time line is important. There should not be a gap of more than 2 years, between Sale of both Flats & purchase of new flat.

sir,I booked a flat on 14.6.2010 ( tentative cost Rs48.45 lakh)on self funding basis,based on stages of construction. Allottmeng letter issue by builder on 21.7.2010. possesson given 25.06.2013 against December 2013 with final cost of Rs.55 lakh app. excl.shifting chges. Flat was sold in March 2023 for Rs 122 lakh,excl brokerage,society dues,misc dues,TDS etc etc. I & my spouse both are now senior citizens. please advise the capital gain tax payable and how to reduce the same.this property is joint one with my spouse.shall appreciate ur early response...rgds....pramod KS.

Thank you for asking about the capital gains tax for your flat's sale. I'll try to simplify the explanation and give you an idea of the tax and how to reduce it. Keep in mind that the accuracy of the answer depends on the details you've provided.

You sold the flat for Rs 122 lakh in March 2023. You made staggered payments for it, totaling Rs 55 lakh, from 14/06/2010 to 25/06/2013. To find the capital gains, we need to adjust the purchase cost for inflation using the Cost Inflation Index (CII) for each payment year.

Since the payments were made over multiple years, we must adjust the purchase cost for each payment separately. For simplicity, let's assume you made equal payments of Rs 18,33,333 each in 2010, 2011, and 2013. The CII for 2010-11 is 167, for 2011-12 is 184, and for 2012-13 is 200. The CII for the year you sold the flat (2022-23) is 331.

We'll adjust each payment's purchase cost like this:
Adjusted Purchase Cost = (Payment * CII for the year of sale) / CII for the year of payment

For the 2010 payment:
Adjusted Purchase Cost = (18,33,333 * 331) / 167 = 36,19,278 (approximately)

For the 2011 payment:
Adjusted Purchase Cost = (18,33,333 * 331) / 184 = 32,94,804 (approximately)

For the 2013 payment:
Adjusted Purchase Cost = (18,33,333 * 331) / 200 = 30,18,000 (approximately)

Now, add up the adjusted purchase costs:
Total Adjusted Purchase Cost = 36,19,278 + 32,94,804 + 30,18,000 = 99,32,082 (approximately)

Now we can find the capital gain:
Capital Gain = Sale Price - Total Adjusted Purchase Cost
Capital Gain = 1,22,00,000 - 99,32,082 = 22,67,918 (approximately)

Since you owned the property for more than 36 months, this is a Long-Term Capital Gain (LTCG). The tax rate is 20% after considering inflation.

Capital Gain Tax Payable = 20% of Capital Gain
Capital Gain Tax Payable = 0.20 * 22,67,918 = 4,53,584 (approximately)

You and your spouse jointly own the property, so each of you will pay tax on your share of the capital gain, approximately Rs 2,26,792 each.

To reduce the capital gains tax, consider these options:

Invest the capital gain in special bonds under Section 54EC of the Income Tax Act. These have a 5-year lock-in period and must be invested within 6 months after selling the property.
If neither you nor your spouse owns more than one residential property at the time of the sale, you can use the capital gains to buy or build a new house within specific time limits under Section 54 of the Income Tax Act. You must buy the new property within 2 years or build it within 3 years from the sale date.

Hello I am a 40 year old married female. Off late I started feeling attracted to my married Male Friend of last 5 years. I love my husband a lot and can never think of betraying him. But now I am attracted to him so much that I can not take his absence or apathy towards me and want to have cordial relations like we were before, when it was not vocal between us that we like each other. I am not able to adjust to the fact that the person who used to admire and respect me so much and wanted to have a lifelong friendship can become suddenly so distant. I want an advise whether I am wrong in expecting atleast a normal relation like friendship to continue between us. As we have never crossed our boundaries and hugging once will not count as betrayal. Hi Sir, I'm 43+, My Monthly take home is around 3.40 Lacs, Currently i have invested in Shares (Current Portfolio is around 1.40 Crs). EMI is around 1.2 lacs P/m (Home loan 1 - 50K per month till 2037, 30K car loan till 2027 (Planning to close this year by paying 13 lacs, please suggest if this option of preclosure is good or EMI is good, will be paying this amount by selling some shares), 30k per month of home 2 till 2040., Last year i have started investing in SIP 1 lacs P/M, and balance 1.20 lacs goes in house, kids education expense. Have EPF balance of 40 lacs as on date. As mentioned above recently i have started investing in SIP (From Oct 2023 onwards), which is at the tune of 1 lacs per month. SIP are Franklin India Prima Fund regular Plan - Growth - 25K, ICICI Prudential Small cap fund retail plan G - 25K, Kotak Multicap fund regular plan growth - 15K, DSP Blackrock mid cap fund regular plan growth - 10 K, and Parag Parikh Flexi Cap fund - Regular plan growth - 25 K. Will increase the SIP investment by 10% every year going forward. Sir, My question is with current SIP and shares investment will i be able to generate 10~12 Cr corpus fund by retirement (Assuming that i will be in Job and working for next 15 years). Current Share portfolio is for long term investment only (assuming i get 12~15% of return every year). Please note : will be spending around 60~70 Lacs for my Son education in engineering from 2027 to 2031, 50% will be spend from savings and balance 50% from education loan. Current value of house 1 - 1.35 Cr (EMI is 50K), House 2 Current Value is 82 Lacs (EMI is 30K).

Your thought process is absolutely spot on. You should prepay the car loan through shares corpus and close the EMI.

If you maintain monthly sip of 1 L with yearly top-up of 10% for 15 years then you may accumulate a corpus of around 8.68 Cr.

Stock holding of 1.27 Cr(13 L considered to be deducted for car loan prepayment) is expected to grow into a sum of 5.31 Cr in 15 years.

EPF balance of 40 L will grow into a corpus of 1.27 Cr over 15 years. Fresh contributions, if any, will be bonus.

So cumulatively your total corpus at the end of 15 years from now will be 8.68+5.31+1.27=15.26 Cr.

Due to your sound financial planning you may not need education loan for son's education.

Modest return of 12%, 10% and 8% are considered from mutual funds, direct stocks and EPF respectively.
