Sir Good day to you. I recently joined a company which is into manufacturing of chemicals our office is located in south Mumbai. I have an vast experience in this industry and considering the offer of the company i have taken up the offer and rejoined this company after 5 years. After joining in the company they asking us to sign a promissory note which come as a surprise. the content of the contract is completely biased and employer centric. The surprising part is that once we resign from this company they stated that we are not supposed to work in the same industry nor with any competitor. Based on the experience we had in the past in this industry we have been offered the job. Further this company doesn't invests anything in training its employees. Here everyone are having vast experience in this segment averaging more than 10 years, so they absolutely no need for them to train on the functionality as this company hire people from competitors only. We need your suggestion that referring to the Indian Labor Law is this a valid contract to upheld the fortune of an employee until he or she make a fraud or misrepresentation made and proven. Is their any legal law withstand in our constitution as Non-competition Agreement and if so what are the guidelines. If it exist how does this help this company as they recruit the employee from competitor itself.

Ans: Dear Mr.Kumar

Indian laws and legal system is a maze. Rather then seeking what is or what is not in the law I would suggest do what works for you. If you are not comfortable signing the agreement don't do it. Because tomorrow if you resign and the company files a case you dont have resources: time and energy to pursue that, while the company has full legal department.

Dear Mayank, I'm amidst a peculiar situation in my professional journey. I work for a private limited company as AGM sales (Industrial) for past 4 years & my contribution to the company's top-line constitutes almost 70% of the company's yearly revenue since I am a KAM of a big strategic account. Over the past 8-9 years, while I have changed my employers on couple of occasions, my client has remained the same (its the same big account that I refer to). However, in the past I have never joined a direct competitor where there has been a conflict of interest. Always I chose to move to an organization with different product line and thereby expand my exposure, while at the same time keeping intact the integrity as well as dignity of during job changes. Now, our direct competitor has approached me with a job opportunity in the same market. My present organisation is relatively small,whereas the competitor is a big MNC with better brand value. I tried to stay away for past 2-3 months citing ethical issues, but they still keep approaching. Please suggest whether it will be a good decision to change. I'm 41 years of age, with 17-18 years experience in Industrial Marketing. Regards, Ashish

If you are happy with your role and the culture of the current organisation, then my suggestion will be to continue with them.

Sir, I did my BMS in HR as well as MBA in HR and got a job in a private media company on their third party pay-roll. At the time of interview, the Company assured me that after a period of 6 months in third party pay-roll they will absorb me in the Company with a salary hike. However, after completing my 6 months, my work even by exceeding the expectation of the company, the company is extending my service with the third party for another 6 months with the same salary stating that they do not have a vacancy in the company to absorb me at this moment. I am very disappointed about this behaviour of the company that after assuring me of absorbing in the company with a salary upon completion of 6 months with the third party payroll, now they are not fulfilling the commitment. I feel I have wasted my 6 months with the lower salary offered by the company under third party payroll. I would seek your guidance as to whether I should take up the extension with third party for another 6 months with same salary or should resign and seek for another job.
Ans: I suggest you ask a legal expert first in the matter to clarify if what the company is doing is correct or not. If they aren't, you are at liberty to take to a legal recourse.Secondly, please be sure that you have a suitable job (as per your expertise and experience)in hand if you want to resign in the current job. Remember, jobs are hard to come by these days. I wont like you to be out of a job!Lastly, why don't you seek an appointment with the company boss and explain to him the problem? Straight talking is best. He will surely help you out!

Dear sir, I have been working in pharma segment n I have a terrible experience to share almost 5–6 companies have not settle my genuine dues of salaries and expenses. Some are almost 5–8 yrs old n the latest one is almost 75 days old. Some have some special statements written on there appointment letters, which gives them freedom , and others seem to have no concerns at all. I cannot take legal action against them as a don't have so much money. In the latest episode, my company says that they cannot give me my full n final till the time stockist does not pays his dues to the company. In this regards, I want to inform you that 1 I have no dues on the stockist 2 I have returned all my property 3 companies settlement time is of 45 days 4 after fighting so long I have received one part as salary but expenses are still held they say that they will only settle my dues when the stockist pays his pending payments. 1 I have no dues certificate from all stockists 2 And my views on this is 1 I'm not in organization now, how am I responsibile for the old payments of my time, because it's responsibility of the current staff to follow up for his secondary n payments 2 party's due on company is around rs 46000 but stockist already has non sellable goods of rs 70000 in his shelf . 3 the current staff do not meet the stockist, help in liquidation of stocks or clearing payments. Kindly help me with your detailed view in how to get my ffs from this organization as I have 1 written several times on main with no proper response. 2 I have called many times to hr n concerned managers but they repeat same thing, ie payments of one stockist Kindly help me with solution to get my ffs from this n old pharma companies. Dear Sir, I did my BTech from a normal engineering college not very famous. The teaching was not great and hence i did not study well. I tried my best to learn coding including all the technologies like html,css,javascript,react js,dba,php because i wanted to be a web developer But nothing seem to enter my head except html and css. I don't understand a language which has more complexities. Is it because of my lack of experience or not devoting enough time. I am not sure. I did many courses online and tried to do diplomas also abroad which i passed somehow. I recently joined android development course because i like apps but the teaching was so fast that i could not memorize anything. There was no time to even take notes down. During the course i did assignments and understood the code because i have to pass but after the course is over i tend to forget everything. I attempted a lot of interviews. Some of them i even got but could not perform well so they let me go. Now due to the AI booming and job markets in a bad shape i am re-thinking whether to keep studying or whether its just time waste. Since 3 years i am doing labour type of jobs which does not yield anything to me for survival and to pay my expenses. I have the quest to learn everything but as soon as i sit in front of the computer i listen to music or read something else. What should i do to stay more focused? What should i do to make myself believe confident. Is there still scope of IT in todays world? Kindly advise.

My married ex still texts me for comfort. Because of him, I am unable to move on. He makes me feel guilty by saying he got married out of family pressure. His dad is a cardiac patient and mom is being treated for cancer. He comforts me by saying he will get separated soon and we will get married because he only loves me. We have been in a relationship for 14 years and despite everything we tried, his parents refused to accept me, so he chose to get married to someone who understands our situation. I don't know when he will separate from his wife. She knows about us too but she comes from a traditional family. She also confirmed there is no physical intimacy between them. I trust him, but is it worth losing my youth for him? Honestly, I am worried and very confused.

I understand how difficult it is to let go of a relationship you have built from scratch, but is it really how you want to continue? It really seems to be going nowhere. His parents are already in bad health and he married someone else for their happiness. Does it seem like he will be able to leave her? So many people’s happiness and lives depend on this one decision. I think it’s about time you and your BF have a clear conversation about the same. If he can’t give a proper timeline, please try to understand his situation. But also make sure he understands yours and maybe rethink this equation. It really isn’t healthy. You deserve a love you can have wholly, and not just in pieces, and in the shadows.
