Hello sir, I am 34 years old and I want good job in MNC IT company with decent high salary package around 1 cr annual. Currently I am working in startup company with annual salary package 5.5 lakh. I have completed BCA and MCA with correspondence. For achieving growth in short time, I wanted to pursue MTech in computer science from IIT. Can I get placed in top reputed company after completing MTech from IIT. Please guide me in this regard.

Ans: Yes you can get placed in top reputed company after completing MTech from IIT. But it may not be easy. You will have to secure admission into one of the top IITs. Out there you will have to perform exceptionally well in academics and in field that is relevant to what is required for by top companies. You may have to take part and perform well in some of the inter college events like Hackathon at National . International level. Even then getting a package of Rs. 1 cr may be possible but not easy.

Hi, We 3 Family Members (Mother and 2 Sons) purchased a Land of 185 Sq.Mtr. with Rs. 78,000.00 in Oct-2001. Now we have sold it in Nov-2024 at 10.80 Lakhs. Each Member will get Rs. 3.60 Lakhs. Now with the Current Index of the said land is Rs. 5730 per sq.meter. Being the 3rd holder will it attract Capital Gain Tax and how much and how it is calculated.

Ans: 01. Individual share of LTCG (Sale price - Cost of plot) will be taxed, as under :
(a). Tax Rate 12.50% without indexation OR
(b). Tax Rate of 20% in case of Indexation.
You may calculate your tax liability under both options & may opt for the tax regime, where tax liability is minimum.

My father bought a house property in 1968 comprising of two floors. He passed away in August 2001 w/out a leaving Will. Me & My elder brother thus became co-owners until we executed two mutual Release Deeds in October 2023 whereby each of us became sole owners of Ground & First Floors respectively. If the property were to be sold by both of us now to a single buyer, will the date of acquisition continue to be reckoned as 1968 ( original year of acquisition by our father ) being a legacy asset and thus eligible for Indexation benefit even post 23rd July 2024 ? In other words does indexation continue in respect of inherited properties where the original acquisition date is prior to 2001 ? Thanks in advance for your valuable opinion please.

Ans: 01. In case of Sale of property by one or both of you, to a single buyer, its date of purchase shall remain 1968 only.
02. In the instant case, you would be entitled to the benefit of Indexation.

I have inherited shares thru Will from my aunt in the year 2008 in the demat form. Since then I have kept as it is & never sold any of the shares as I'm not well versed with the market. Now as there was some urgent expense in the family I had to sell few shares. So Sir, my question is as I have inherited shares by Will, so should I have to pay Capital Gain tax on the sales of shares. If yes then how it is calculated. Please advise.

Ans: 01. There is no issue of inheritance involved in this case, as far as income tax is concerned.
02. If you sell shares, it would be subject to LTCG Tax under Income Tax.
03. Please note that only Gain would be taxed & not gross receipts from sale of shares.
04. There would be a tax exemption of up to Rs.1,25,000.00 per year on LTCG. Beyond this amount, it shall be taxed @12.50%.
05. If LTCG amount is more, then you may plan for certain other exemptions available under the income tax (u/s54F).

Good morning Mahesh sir. I am a PSU employee with 30 years exp , age 54 yrs. My present PF amount is Rs 194 Lacs , out of which my contribution including VPF is Rs 120 Lacs approx. As Govt is imposing tax on the interest above 2.5 lacs / yrly, I am paying heavily in terms of taxes. I do not have PPF. Please guide me to save the reduce the tax on this interest on PF amount.

Ans: 01. You may withdraw maximum amount (which is eligible for purchase of a house) from your PF Account & Invest the same in purchase of a house or Flat. This may reduce your tax burden on account of heavy interest on PF & gives you the leverage of appreciation of value of your purchased house.
02. You may open a PPF Account & put your future savings in that account.

My mother transferred her share of ancestral property to my one maternal uncle(out of 6) some 15 years back. He had made some excuse and promised to transfer it back after 6 months but later on he divided it into 6 parts. We have no proof that he promised to return it. Can my mother reclaim her share now?

Ans: 01. When you make a Gift to someone, it can't be claimed back. At least it is not your legal right to claim it back. However, its just mutual understanding between two parties.
02. If your maternal uncle has divided the amount in 6 parts & shared the same with all 6 brothers, you can't exercise any choice or preference. It is his prerogative, to utilize the property in a way he likes.
Your mother probably has no right to reclaim her share.

Hello, I had brought a 2bhk for 1.15cr in 2015 with a bank loan of 65 lacs with present outstanding of 29 lacs. The present price of this property on sale is around 1.25cr. In 2023 I have bought another property for 2.00cr with a loan of 1.67cr. Does it make sense to sell the earlier property at a loss and prepay the new loan? What will be the tax implications? I am 51 years old now.

Ans: 01. You may sell the flat purchased earlier & pay off its loan. However, you would be entitled to LTCG Exemption only if the Purchase of New Flat & sale of old Flat is with in one year. Please compare the dates of Registration of both flats, since timeline is very important in this case.
02. Are you earning any income from the old flat ? If not, you may sell the property & repay the housing loan against new flat.
03. However, if you are earning reasonably from old flat, it would be beneficial to keep the same & utilize its income to pay EMIs.

My son is pursuing B Tech Civil (2nd year now) from PEC Chandigarh. He needs to go for IT job in future. Please advise what should he do to achieve his goals

Ans: He must be comfortable with one or more computer languages like C & C++. Apart from that he must be comfortable with CODING, Data Science, Basic Mathematics. It's an age of AI and Machine Learning. He must go for some good certification course which is having collaboration with some reputed IIT. Before going for the certification course he must know their syllabus and practise at least two months by viewing good YOU TUBE videos of the concerned subjects and relevant topics. Please note he is changing his line from Civil to IT. So he has to compete with the students who are doing B.Tech in circuit branches like Electrical, E&TC, Computer, IT and Instrumentation. I started working in 2005 and until 2014 there is no cary forward of my PF money and for the matter of the fact i dont even know how much money is lying in EPFO for my employment duration 2005-2014 (i worked in GGN, BLR & BOM). please guide how can i seek the details of my Pf corpus from 2005-2014 and consolidate it with my current active UAN account?

Ans: Bets way seems to be to visit EPFO office to seek details.
However, your previous employer(s), who deducted PF & deposited in your account may also help you to get the relevent details.
