I purchased a industrial property in1993 For 10 lakhs. Now the value is about 22 crores. I will invest the sale proceeds for a house of 1 cr . If I sell the property how much Capital gain tax I have to pay

Ans: Assuming sales consideration is 22 crs then you will get the exemption to the extent of 1/22.

I have purchased a plot of land in April 1987 for Rs.46000. I completed ground floor construction of my house in Oct 1990 with a total cost of Rs.21600 and completed the upper floor construction in May 1999 at a cost of Rs.600000. I propose to sell the property now for a total price of Rs.1cr. What will be my Capital Gain tax liability

Ans: Your long term capital gains (LTCG) would need to be calculated based on your indexed cost of acquisition of plot, construction and any improvements or alterations done by you of a permanent nature. For doing this, your original costs, inflated by the CII (Cost Inflation Index) as given out by the Govt from time to time is to be used.

The current CII is available from 2001 onwards, while your purchases relate to much earlier. There are ways of handling this including a valuation to be done by a competent professional.

I would recommend you to approach a Govt certified valuer or a CA to evaluate the LTCG in this case.

Ans: Hello;

12.5% on 1.1479 Cr: 14.34 L

OR

20% on 82.82 L (Gain arrived after deducting Indexed cost of acquisition from sale price): 16.56 L

Dear Guru. I have inherited a property in Mumbai from my deceased father which was purchased in 1983 by him. If today i sell the property which is worth 2.60 Crs whats my capital gains tax and how will it be calculated

Ans: 01. In absence of exact figures, it is not possible to calculate your Capital Gains Tax. However, following details may help you to assess your tax liability.
02. Under present provisions of Income Tax Act, you may opt any of the options (Long Term
Capital Gains), as under :
(a). Tax Rate 12.50% without indexation or
(b). Tax Rate of 20% with Indexation.
03. You may calculate your tax liability under both options & may opt for the tax regime, where tax liability is minimum.

PPF Balance is 1.18L, investing around 20K per year investing in NPS from Dec'22 onwards and currently holding 2L and investing 50K every year and also investing 4500 monthly through employer from my salary( above mentioned sal is excluding this amt) Investing 9k per month in 5 mutual funds 1.Kotak infrastructure and Economic reform fund - 2k 2.Quant infrastructure fund -2k 3.Bandhan sterling value fund - 1k 4.SBI long term equity fund - 2k 5.Quant Multi Asset fund - 2k Paying LIC of 27K per year for 10L sum assured. currently holding a personal loan with an EMI of 27k per month, same will be closed by Dec'25. Please guide me on how to achieve 1Cr in next 10 years and where to invest to achieve my target.

Ans: Hello;

You may be able to achieve 1 Cr corpus in the following manner;

1. Do a flat monthly SIP of 50 K for 10 years.

2. Begin with a monthly sip of 15 K and step it up every year by 30% minimum.

Other option is to do a flat monthly sip of 20 K for 17 years to achieve 1 Cr.

A modest return of 10% is considered.

Also your funds need a complete rejig for which you may get in touch with a MFD.

My son is pursuing Mechatronics in VIT Chennai. He does not have too much passion towards software programming etc.He is interested to pursue M.S abroad like Germany etc instead of doing GATE /PG in India. I personally feel doing GATE in India and if admitted to premier central institutes hold more value and makes economical sense. Please advise which one is better - if abroad, any specific countries you recommend which has more value for higher education/Career opportunities ? Secondly, What career options within India is good. Is IES a good option if so what specialization should he choose for preparing ?

Ans: IIT through GATE is better. IES is good option with Electronics/mechanical

I am 72 years old. How much is the LTCG ? How much do I need to invest in the CG Tax Saving Bonds to minimise the tax ? What will the tax amount payable ? Thanks and regards

I sold a property for Rs130 lacs in this month. I bought it for Rs.18 lacs in August 2005. I bought in joint name of self and spouse. I got the sales payment equally in both names. We do not wish to buy another property as I am over 70 years of age and my wife over 67 years. How much should we each invest in CG Tax saving bonds to get exemption ? Both of us are filing returns separately.

Hi My father purchase ist and barsati floor in 1986 @ 2 lac... He made 3rd floor construction... We dont have construction expenses bills Now he want to sell@ 10 lac each floor to 3 indiviual buyers, means total 30 lac sale considration ., how it can be shown in income tax... Will 2 lac buy value is divide in 3 floor?

Ans: 01. As per details provided in the question, your Cost for all the three Flats is Rs.2,00,000.00 only. This is due to lack of documentary evidence about Cost of Construction (Bills & Source of Finance etc.).
02. LTCG tax may be comparativly less, if you opt for LTCG calculation without Indexation.
03. I would suggest you to get a Certificate of an Architect, who would certify the cost of your property as on 01.04.2001. You may treat this as your Cost for 3 flats and work out your tax details.

I bought a flat in 2000 for 15 lakhs. Recently my wife got a share of land from her dad through settlement deed. We want to construct a house in few months time. Im planning to transfer my flat to her name through a settlement and then sell it for 1.5 crores so as to fund the new house. Will it still attract CG tax for me or for my wife?

Ans: In case you transfer asset to your spouse for inadequate consideration, Income out of such asset will be clubbed in your hands.

Hello Sir, I am 35 year old working women & having SIP of 51K for 15 years. I started it 2 years before.(Current amount is 14L) My salary is 85K per month. I have 10 years daughter. I have currently purchased 2BHK home having home loan of 50L for 15years.My target is close the loan in next 5 years. Rent is coming 15K. EMI is 70K.(35K husband pays the EMI).NPS is 50K yearly. LIC 35K yearly. I want to retire by 2036 with amount of 2cr.Please suggest.

Ans: Hello;

With your current sip of 51 K you may be able to achieve a corpus of 2.13 Cr in 15 years time frame. (Assuming modest return of 10%).

You may use partial withdrawal from NPS/EPF, if any, and LIC policy proceeds to prepay the home loan.

Till now I was filing income tax returns every year including the rental income for a flat jointly owned by me and my wife. For AY 2024-25, the rent was included in my wife’s ITR for convenience and no ITR wea filed by me as I had no other income. Is this ok?

Ans: No

Rental Income is required to be offered by owner/owners who has contributed in acquiring the property.
