Myself filed ay 23-24 ITR and re verified . but after 1 day i found 1 little mistake and tried to fill it offline but by bug in offline tool it taken zero income . i did't verified it .i received the tds refund according to original itr but i regulary getting e verify itr messages . then what to do now or just ignore it. Rahul

Ans: Will need to understand what was the little mistake that you made. If the mistake results in any additional tax liability then technically you have received more refund. You may revise your return online with the correct numbers.

The return filed offline is certainly incorrect and you may not e- verify the same.

Please seek guidance from your CA and take an informed decision.

I am a retired male senior citizen. I filed my income tax return for AY 2022-23 in form ITR-1 on 22nd July 2022 with NET Taxable income of 427200 with a mention of 5070 for rebate under 80 D towards my mediclaim insurance annual premium. Before doing the e-verification on line through Aadhaar linkage I noticed that my actual mediclaim insurance premium is 7070 which I had erroneously mistyped as 5070. So instead of e-verifying my above erroneous filing I filed a Revised Return on 20th August 2022 correcting the 80 D rebate claim to 7070 and the Net Taxable income became 425200. I e-verified this Revised Return immediately on line through Aadhaar linkage. Within 2 days of my filing this Revised Return I got an assessment Email from Income tax department where they have treated this Revised Return as Late filed Original Return and imposed a late fee penalty of 1000 and issued a Refund Order of my TDS. As such on my Net Taxable income of 427200 as per Original Return or 425200 as per Revised Return Income Tax is '0'. It appears that since I didn't e-verify my Original Return they have treated Revised Return as Late filed Original Return and imposed late fee of 1000. Now I am getting repeated emails from Income Tax department that I have not e-verified my Original Return of 22nd July. Can I e-verify my Original Return now and claim Refund of the 1000 Late Fee deducted by them? Shall be grateful for guidance and advice.
Ans: Return is taken up for processing only when it is verified. As revised return is verified before verifying original return, revised return is considered as original return. So in my view, even if original return is verified now, late fee will not be waived off as original return is considered to be filed after due date.

Good Afternoon Sir, recently, I filed online ITR for AY 2023-2024 I am NRI working in Saudi Arabia. I received email with below subject "Important - Rectify the defect in your Return of Income" I need to rectify and return file returns again on or before Aug 03, 2023 Can you help on this matter with chargeable fees
Ans: Good Afternoon Aejaz,

I understand your concern about the notice you've received regarding a defect in your Income Tax Return for AY 2023-2024. As an NRI working in Saudi Arabia, it's crucial to ensure your tax filings are accurate.

The notice you received typically means that there might be some discrepancies or missing information in the return you've filed. This could be due to a variety of reasons such as incorrect reporting of income, deductions, tax credits, etc.

Here are a few general steps you can take:

1. Review the Notice: The Income Tax Department usually provides a reason for the defect in the notice itself. Review it carefully to understand what the issue might be.

2. Check Your ITR Form: Go through the ITR form you've filled out. Make sure all the information is accurate and complete. Pay special attention to the sections related to foreign income, as this is a common area where mistakes can occur for NRIs.

3. Rectify the Defect: Once you've identified the issue, you can rectify it by logging into the e-filing portal. You'll need to revise your return with the correct information and submit it again.

Please note that this is general advice and the exact steps might vary depending on the specifics of your case. If you're finding it difficult to rectify the defect yourself, it might be beneficial to seek professional help. As a tax professional, I can certainly assist you with this on a chargeable basis.

Remember, the deadline for rectifying the defect is August 3, 2023. It's important to act promptly to avoid any further complications.

I hope this helps! If you need further assistance, feel free to reach out.

Dear Sir I have filled ITR and there is refund 15003 I filled ITR on 02 July and did not E-verified due to Pan Card Blocked by Govt so after file ITR i sent its signed copy to Bangalore on 3 July that showing verified on 10 Aug and i Have paid 1000 on 12 Aug to link pan card and Aadhar card and got linked then i received mail on 12 Aug evening to E-verify return but there was no option to E-verify return . today is 09-08-2023 but we have not received refund yet Please suggest right process 2-3 days back i have complained in grievance of ITR .Please suggest right process . status on Dashboard showing Return Filed on 2 july and Return verified on 10 July only .....
Ans: ITRs can be filed without having the Aadhar-PAN link completed; however, such ITR filings would render the user ineligible to avail refunds and interest on such tax refunds till the time PAN is linked with Aadhar.
• After e-filing your return, you must verify it. Your return filing process is not complete unless you do so.
• The timeline for e-verification of returns filed after 1st August 2022 is 30 days from the date of submitting the return.
• As per the IT department, if the ITR filed is verified (electronically or by sending ITR-V to ITD) before the time limit of 30 days, then the date on which the return was filed will be considered as the date of furnishing ITR.
• In the offline verification case, the speed post-dispatch date of the duly verified ITR-V will be taken into account to determine the 30-day period starting from the day the income tax return was electronically transmitted.
As per the data provided by you, your return has been verified within the timeline of 30 days. Normally, it takes 20-45 days for the refund to reach you after filing and verifying your ITR but your Aadhar and PAN got linked on 12th August. The delay in refund is due to it.

We suggest you wait for some more time and regularly check the “My Pending Action option” in your income tax account portal.
