In April 1973 my eldest sister purchased a plot of land which she gifted me through registered deed of gift dated 23rd August 2004. I have sold the same though a deed of conveyance dated 14.03.2024. A govt. registered valuer is chalking out the valuation of the land as on 01.04.2001 (the cut-off date of IT dept) to enable me calculate the capital gain tax under IT indexation which is approx. 350 in 2024. Taking the valuation as 'X' on 01.04.2001, the present valuation becomes 3.5X. How can I calculate the nett capital gain the sale value being say 'Y' with what allowable deduction of expenses applicable? May I have the detailed clculation to arrive at the taxable capital gain?

Ans: Your thought process is right as far as indexation is concerned. It will be 3.63X to be precise.

The deductible expenses are any sale related expenses like brokerage etc from capital gains tax computation.

I have purchased a land of Rs. 2.5 Lacs in 2001 and start constructions on that in 2005 with 2 floors and also completed the constructions with in 5 months. Taken a loan from DHFL of Rs. 5 Lac and also repaid in next 2-3 years. Just two years back also extended one floor. Now there is 3 complete floor and one half floor is there. If today I sell this property (which is approx 80 sqyds plot size) in 70 lacs then how much capital gain tax (if applicable) I need to pay. Pl. also note that we don't so much documents for constructions related and total exp. is around 25-30 Lacs on that.

Acquisition Cost:

Indexed Cost of Acquisition and Improvement:
To adjust the acquisition cost and cost of improvement for inflation, we need to calculate the indexed cost. Capital Gain = Sale Proceeds - (Indexed Cost of Acquisition + Indexed Cost of Improvement)
Capital Gain = Rs. 70 lakhs - (Rs. 7,92,500 + Rs. 88,76,000)
Capital Gain = Rs. -26,68,500 (Assuming the indexed cost is higher than the sale proceeds)

Since the calculated capital gain is negative, it means there is no capital gain tax applicable in this case. This is because the sale proceeds are less than the indexed cost of acquisition and improvement.

You are not overthinking. Wanting privacy about your relationship is a reasonable boundary. His friendship might be older than your marriage, your consent to share sensitive information which involves you still applies. And friendship and marriage are two different things, and each has its own place.

The best solution to this situation is to have a conversation, the right time, right place and right way. Pick a time when both of you are calm and relaxed. Frame the conversation around trust, not control. If it sounds like you are asking him to choose marriage over friendship, he might get defensive. So, highlight your emotional safety instead of sounding accusatory that he is making you feel a certain way. Be specific about your boundaries: bedroom talks are off limits, or personal insecurities should not be shared outside of the marriage. Everyone needs someone to vent to, and talking to friends is okay, but not when it makes your partner uncomfortable. Acknowledge that he needs to talk to someone about things, but remain firm about your boundaries. If he still brushes it off, let him know that joking about your private matters hurt your deeply. If nothing else works, I really suggest marriage counseling. Sometimes people need to hear the hard things from others, instead of their partner, to understand it's validity.
