Recently Sold My Flat - Can I Use Proceeds for Business and Education Before Reinvesting?

Good afternoon. i have just sold a flat for 95 lakhs. And i plan to reinvest the entire proceeds in an under-construction flat over th period of 3 years from the date of sale. However during these 3 years, i will still be having a part of the sale proceeds at any point of time. So can i use these sales proceeds immediately in whole or in part, for purchasing some other commercial property and for my sons education ? However, I will still be able to generate other monies to pay for the underconstruction property which I have invested. In such a case, do I need to pay Capital Gains Tax even though I have complied with the reinvestment rule of SEction 54 ?

Ans: For taking benefit of Sec 54, amount of gain is required to be invested in new property. You can use balance money any other purpose
