My father died 7 years ago leaving some fd with mother as nominee. She had subsequently withdrawn them and invested elsewhere in her name, can I , the daughter ,get anything from it?
Ans: Hi Sunitha,
I'm so sorry to hear that. But as a nominee, your mother is not the ultimate owner of the funds, she only acts as a trustee.
As per Indian Succession Act, if your father doesn't have a will, all his assets will be equally distributed amongst his mother, his wife and children. It means you have the equal right in that.
But as she has already made the withdrawals, you can challenge the same in the court and get an equal portion for yourself. You should consult a civil lawyer in this case.
Let me know if you need more help.
