Hi Mihir, My father in law gifted his flat to my wife, now she asking for rent. Can I pay her rent and claim HRA deduction, I am an PSU employee. We leave in same house and I do not own any house.

I am S Rangarajan from Chennai working with a private company in Chennai, stay in a rented house and claim HRA. In Jul 2019, I have booked a flat jointly along with my spouse in Chennai (before construction) and paying interest and principal from the date of booking to till date. The project was handed in Nov 2022 and the flat is kept unoccupied despite being in same city due to distance constraints for my son's schooling. However, I have plan to let it on rent from 01 Apr 2023. I need clarification on the following. Am I eligible to claim interest and principal and also the HRA? My employer is objecting to claim house loan benefits as well as HRA. Need your advice please. S Rangarajan
