Sir, After a hospitalization in June and July of the current year, my relative with taxable pension expired before filing ITR on due date. I understand that it is the duty of the heir to fulfil the task of filing the ITR. While form 16 can be obtained from bank, Form 24AS can be accessed through Tax Portal login only. But password is unknown. To verify possible communication from the from the IT dept, the email address and password is also not known. Please advise how to proceed in such a situation. If we approach the IT Office, will they help in digging out the Form 26AS? I assume there is a fine (of Rs,5000/- in this case) for belated ITR filing. Is there any provision to request for any exemption on fine by submitting the PAN and death certificate?
Ans: 01. First of all, Collect Form 16 from the bank & calculate your tax liability for the period under reference.
02. Pay the tax due, which does not require any login etc.
03. Penalty of Rs.5,000.00, will have to be paid. However, you may defer the same till filling of ITR.
04. If phone number is still active, you may try to generate password by using the option of "FORGOT PASSWORD."
05. Ultimately, Representative Assessee, shall be will fill the return by getting it approved by IT -Department. This may require certain formalities to be completed at your end.
