Sir, On 14-June 1994, I acquired a flat (tenement) in my own name for Rs. 2,98L. In April 2015, I had to spend Rs. 4.15L on general renovation of this flat. Now, I plan to sell this tenement and wish to invest its sale proceeds within two years of the sale in buying a ready possession flat in another city. My queries are follows: 1. Can I invest the sale proceeds in buying two flats in the same society of the new city or do I have to necessarily invest in one property only? 2. Can I add the name of my spouse and my son also as co-owners in the new property(s) even if their financial contribution is nil? 3. Can I add the name of my spouse and my son also as co-owners in the new property(s) in case they also partially contribute financially in the purchase of the new flat(s)? 4. What is the present applicable Indexed Cost of the flat planned to be sold by me?
Ans: Hi Thomas
As the base year for Cost Inflation Index (CII) has been reset to 2001, you may need to get a valuation done through an approved valuer to identify the value as on April 1, 2001. If this value is higher than Rs. 2.98 Lakhs then you could use that as the cost.

As regards the general renovation amount spent, it may not be allowed to be added as cost of the property as generally tax officers are not dispensed to allow it.

W.R.T. your decision to reinvest in a ready possession flat within 2 years, please note that if this investment is extending beyond 6 months OR due date for filing your tax returns (whichever is earlier), you would need to open a Capital Gain Account Scheme (CGAS) account with a nationalized bank and park the capital gain amount in it for reinvestment.

Now answering your queries

Query 1 - If the capital gain amount does not exceed Rs. 2 Crores then you could reinvest in 2 residential units. This however is a one time option and cannot be used again in any other year.

Query 2 - Yes you could add their names but they would be treated as name-sake owners and for all purposes of taxation, you would be taxed singly.

Query 3 - You can add their name as proportionate owners to the value of their contribution. The taxation of income in that case would be based on their contribution

Query 4 - The answer to this would depend on the valuation report. Nevertheless, you could derive the indexed cost yourself by multiplying a factor of 3.48 to the cost. An example would be as follows:

Suppose the cost is Rs. 2.98 Lakhs
Indexed cost would be Rs. 2.98 Lakhs x 348 / 100 OR 2.98 Lakhs x 3.48 = Rs. 10.37 Lakhs

Sir We bought a flat 4 yr ago with 67 lakhs with loan amount of 50 lakhs, recently we sell gold worth 25 lakhs and clear all personal loans and debts. Now we are planning another flat worth 95 lakhs with loan amount 80 lakhs...so now we have 2 home loans ..can we continue the 65 lakhs flat for rent 20 k or we sell the flat .total salary 1.6 lakhs per month . We have car loan also .
Ans: You have shown good intent by selling gold and clearing your debts.

Still, this new flat purchase needs careful review from all angles.

Let us assess your full situation and suggest a balanced, long-term approach.

This answer looks at every part of your current financial life.

Current Home and Existing Loan
Your current flat was bought for Rs.67 lakhs four years back.

Out of that, you took a loan of Rs.50 lakhs.

The current rental income is around Rs.20,000 per month.

This rent gives about Rs.2.4 lakh per year.

Rental yield is quite low in comparison to your loan EMI.

Real estate often gives rental returns of only 2–3% per year.

But your home loan interest is around 8%–9% yearly.

This gap creates a burden on your cash flow.

Keeping this flat only for rent may not be financially helpful.

Your Salary and Existing Loan Burden
Your total salary is Rs.1.6 lakh per month.

That is good, but needs proper budget management.

You already have one home loan and one car loan.

A second home loan of Rs.80 lakh will be a big load.

Two home loans and one car loan will stretch your EMI ratio.

Your EMI commitment may cross 60% of salary.

This makes day-to-day life stressful and risky.

Banks also limit eligibility if EMIs cross 50–60% of salary.

New Flat Plan – Is It Suitable Now?
You are planning a flat of Rs.95 lakh with Rs.80 lakh loan.

This is a big jump from your earlier flat price.

Loan EMI alone may be around Rs.65,000 to Rs.70,000 per month.

Managing this EMI along with old loan EMI and car EMI is difficult.

Plus, other expenses, bills, and savings will also need cash.

Property tax, maintenance, and interiors will need extra funds.

With your current salary, this may cause heavy strain.

And if job loss or emergency happens, the risk is high.

It is better to delay this second flat unless cash flow improves.

Keeping or Selling Existing Flat – What Is Better?
The rental income of Rs.20,000 is very low against the cost.

EMI, maintenance, and tax on that flat reduce actual returns.

Also, resale value after 4 years may not be very high now.

Selling the flat can help reduce your home loan burden.

You can use the sale amount to reduce new flat loan or invest.

Or, if you cancel new flat purchase, use funds for better financial goals.

Think about whether you need two flats at this stage.

A second flat gives low returns and blocks your liquidity.

Instead, one good home and mutual fund investments give better results.

Alternative to Property – What You Can Do Instead
With your surplus from salary, start investing in mutual funds.

Mutual funds are flexible, tax-efficient, and transparent.

Returns from mutual funds over long term are higher than rent.

You can start SIPs as per your risk level and goal duration.

Equity mutual funds help in wealth building.

That was a good step. You have reduced bad loans smartly.

But don’t use all your assets for property again.

Use some gold money for liquid funds or emergency corpus.

Emergency Reserve and Liquidity Planning
Every family must keep 6–9 months of expenses as emergency fund.

This must be in liquid mutual funds or bank deposits.

Liquidity is safety. Not having cash causes problems even with assets.

Build an emergency fund of Rs.3–4 lakh minimum.

Car Loan – Should You Clear or Continue?

This is a depreciating asset. It does not grow in value.

Try to close this loan early if possible.

Paying high interest for car EMI reduces your savings.

Thank you sir for your guidance dt 31st May. My son passed 12 ICSE with English 98 marks, PCM group 60% and Mass Com. Wanted to pursue English at best colleges, but CUET score is 380. So St Stephens, JMI n other best DU colleges are out of question. St Xaviers Kolkata was not available at his 282 marks against the cut off 292. Jadavpur, Presidency Kolkata and Christ Bengaluru were closed for registration by the time, we allowed him to pursue English as against our stand to go for B Tech, so that he being the only child can take over the family's heavy engg business ( father has the dealership of Alfa Laval). His JEE percentile was 20. BITs was not possible due to condition of 75% in PCM. NDA also not cleared. IISER rank is 11000+, which is too less for General category. So against the backdrop of dismal scenario, he tried MIT-WPO, where he is getting Applied Economics, Applied Psychology, both as Majors and also possibility of English classes arranged from Harvard or any other global institution. He also got CSE( AI and ML) at D Y Patil, Ambi Pune. Whether he will be able to cope up CSE, as he did not study Computers in classes 11 and 12. He is fascinated by the idea that if he goes for B Tech, his father may arrange interships at Alfa laval here or in Sweden, or other Corporate companies. Kindly guide us what is best for him? Humanities at MITWPS or CSE D Y Patil? I was also thinking of allowing him to go for MIT for on campus course and also enrol him at IIT, Patna, Gauhati or Jodhpur for online BS degree in Data Science and AI, so that his passion and his techological requirements in future, can be amalgamated.
