Hello Respected sir, I have an old land worth 2 crore which I am planning to sell.Original sale deed is of Rs 1 lakh Can you please help me: 1. How much tax have to pay? 2. Where should I invest rest for max return? 3. Currently living on rent but planning to buy 2 flats around 50 lacks each. I will stay in one and the second one will sell. Is this correct? 4. My current income is 2 lakh a month and I have kid only. Investments already in PPF monthly 10K, Sukanya Yojna monthly 20K rest expenses 60K monthly. I am a 44 year old married. My Goal is to have: 25 Lakhs for Education in next 7 yrs and Retirement income 1Lakh a month.

Ans: Hello;

1. You have 2 options of long term capital gain tax working because you have old land.
a.200-1=199 Lakhs on this a tax of 12.5% i.e.24.875 Lakhs
b.200-x=xyz Lakhs on this a tax of 20%
Where "x" is the inflation indexed cost of acquisition
You may consult a CA for calculating "x" for you and also recommending ways in which you can avoid payment of this tax based on provisions of income tax act.

If you can save on entire tax payment by reinvesting the capital gain from land sale into real estate then it makes sense to invest in real estate. You may rent out part of your real estate to earn rental income.

You may do a monthly sip of `90 K in an equity savings type mutual fund with low to moderate risk for 7 years.

It may grow into a sum of 1 Cr after 7 years assuming modest return of 9%. It may be utilised to fund higher education of your kid and partially funding your retirement income in addition to rental income.

Hi Mihir- I have to sell an inherited old house made before 1987. The price at that point may be 7 Lakhs. The valuer gave a report of value of 32 L in 2001 and indexed cost of 1.15 CR in 2024. I am planning to sell at 5 CR registration value? How will we calculate the LTCG on the sale proceeds? How can we utilize the LTCG. How many flats can we buy from the amount - is there a limit? I have 2 properties in my name. Also, I have loans pending Upto 3 CR. Can I pay them back? Two loans were taken last October 2023. What will be the tax implications if I don’t invest ? What are the best ways to invest and save on LtCG accrued basis the sale. Thanks for your response
Ans: The biggest change is that the benefit of indexation gets withdrawn. In simple terms, now you cannot adjust the purchase cost of the property for inflation to bring down your taxable capital gains.

Flat Tax Rate: The LTCG from property shall now be taxed at a single 12.5% plus applicable cess.

The base year for computation of capital gains in respect of properties acquired before April 1, 2001, has now been shifted from 1981-82 to 2001-02.

Point to Note:
Fair Market Value (FMV) as on April 1, 2001: You may opt to consider the FMV of the property as on April 1, 2001, as your cost of acquisition for the purpose of computing capital gains.

Assuming you opt for FMV as on April 1, 2001:

FMV as on April 1, 2001: Rs. 32 Lakhs (as per your valuation report)
Sale Price: Rs. 5 Crores
Capital Gain: Rs. 5 Crores - Rs. 32 Lakhs = Rs. 4.68 Crores
Tax: Rs. 4.68 Crores * 12.5% = Rs. 58.5 Lakhs
Availing LTCG
1. Section 54EC Bonds:

Invest the amount of LTCG in bonds issued by NHAI, REC, IRFC, or PFC within 6 months from the date of sale.
You can claim full exemption from tax on LTCG.

2. Section 54F:

Invest in a new residential house within 2 years from the date of sale.
You can claim exemption from LTCG tax to the extent of the cost of a new house.

3. Capital Gains Account Scheme:

Deposit the amount of LTCG in a Capital Gains Account Scheme within 6 months from the date of sale.
You get 3 years to invest in a new residential house.
If invested within 3 years, no LTCG tax is payable.

Flats Purchase
There is no specific limit as to how many flats one can purchase from the sale proceeds. However, if you are investing the amount to claim exemption under Section 54F, the property should be for self-occupation.

Loans and Tax Implications
You can use the sale proceeds to repay your loans, including the ones taken in October 2023. But it will not qualify for LTCG exemption. In case you fail to invest the LTCG amount to claim exemption, then you will have to pay tax on the LTCG as computed above. However, the property purchased on October 2023 can be considered for LTCG exemption. Please consult a tax advisor one on one to get clarity on this.

Best Ways to Invest and Save on LTCG
Prioritize Section 54EC bonds for full exemption.
If you plan to buy a new house, consider Section 54F or CGAS.

Till recent, i'm not aware that the rate of interest being applied is 10.5% and still it is shown as 213 EMIs balance to be remitted as on 18.02.2025, despite no pending or late payments at my end. Please advise what to be done sir!

Ans: The NTA has started conducting eligibility exams for all PG courses, including professional courses like Pharmacy (MPHARM), known as the PG CUET exams. This is the first year for these exams, with 174 universities participating: 41 central universities, 38 state universities, 12 government institutions, 14 deemed universities, and 69 private universities. Similar to NEET, universities from all over India are involved, so you need not worry. Additionally, you may be able to obtain a scholarship to pursue your course. In the near future, many more universities are expected to join this initiative.

For your specific situation, you need to appear for the entrance exam for TEST PAPER SCQP17, based on the course you have studied and the one you have selected. In some cases, the syllabus is also provided. Therefore, you don’t need to struggle with the admission process. However, you should research which courses are offered by each university to gather the necessary details individually. If you haven't registered this time, you can always try again next time. Please note: A candidate can take up to four different test papers.
Both courses are acceptable, but consider pursuing an MSc in Clinical Embryology and Assisted Reproductive Technology for a better future.

Hi i am a married woman aged 45 years, i am happily married and have a loving husband. My husband travels a lot due to work and my son is studying in college in Pune. Everything was going fine in my life, but few months back a MBA graduate boy 23 years joined our office in my team. He had to report to me, and our company send us for sales corporatemeetings to Mumbai and other cities often. Gradually we became close and he confessed he had a crush on me. I was falttered but told him i am much older and married. Although i was very flattered that he found me attractive. I am tall 5ft 7 inches and kept myself very fit and always men keep hitting on me but i always ignore them. On our last trip together we went for a meal and had a few drinks together. Then i told him i was sleepy and needed to go to my room. He accompanied to my room and had a coffee. I had a bavk ache and he said he can massage me for 5 mins. I hesitantly agreed during the massage one thing led to another and we had sex and since then we have started having sex whenever we travel togther often. He says he truly loves me but for next 5 years he cannot marry anyone. I have now started loving him a lot i often fight with my husband. I want to continue this affair but am afraid if my husband finds out or if people in office come to know. Strangely another young man in office has starterd showing interest in me and asked me out for a coffee. If you do not have an open marriage, then what you are doing is certainly wrong. When has cheating ever been right? Especially when you did not mention anything wrong with your husband. I am not judging you; but I would suggest that if you want to keep this up, you either come clean to your husband or let him go. This isn't fair. You living your life to the fullest should not harm or hurt others.
