Dear Sir, I have not able to file return for AY 2022-2023.But I have deposit due tax of AY 2022-2023 through clear tax.com which they are showing during filing return but found afterwards that i don't have any tax liability of AY 2022-2023 after seeing my FORM no. 16. My company deducted 13000 & deposited to Income tax authority. when i consult for refund of amount from Clear tax .com. They replied that we have given money to Income tax authority & it is showing in your account. we cannot refund the money. My bank account is debited with Rs20000. what can i do now. please advice. if you have any mobile no. or email id please share. Thanks & Regards, Manish Kumar Kharagpur West Bengal.

Ans: During the filing income tax return, if person forgot to claim amount of TDS or tax paid, same can be claimed by filing revised income tax return. However, due date for revision of the income tax return for AY 2022-23 was 31.12.2022.

Hi I had used the services of ClearTax to file my tax returns for the financial year 2021-22. ClearTax had appointed a CA to be by point of contact and to file my taxes. Everything was going smooth and they had sent me the final filings (ITR-3) for me to approve and pay off the tax. I paid the tax and gave the go ahead to file my returns. They filed my returns on 31st July2022 and then I noticed by mistake the CA had filled someone else's returns (ITR - 1) with all wrong numbers also using in the old tax regime. I immediately got his attention and he said that it was busy time and by mistake he attached someone else's filings to mine. He immediately corrected the mistake on 2nd August and filed mine with the right details. I asked him multiple times if it will be a problem to which he clearly said nothing to worry. Fast-forward to February 2023 and I got a notice from IT department that since I had submitted my filings in old tax regime as on 31st July I have pay 85K + additional tax. I have taken up to the clear tax team and they are making us run around in circles. Now the latest is the clear tax team has filled a grievance with the AO. My questions is any chance that it will be reversed as along clear tax team has been saying its not our fault don't worry everything will be ok. They are just making us run around. Do you think I will get my money back

I understand your concern and the stress that such situations can cause. Mistakes in tax filings can have repercussions, and it's essential to address them promptly.

Regarding the notice from the IT department, the fact that you've received a notice means that the department has identified a discrepancy in your filings. The grievance filed with the Assessing Officer (AO) by ClearTax is a step in the right direction. The AO is responsible for assessing and reassessing income, and they have the authority to rectify any mistakes.

Given that you have evidence of the mistake and its rectification, there's a good chance that the AO will consider your grievance. However, the process might take some time, and there's no guarantee of the outcome. It's essential to keep all communication and documentation related to this issue handy.

As for getting your money back, if the AO acknowledges the mistake and rectifies it, you might be eligible for a refund. However, if the AO determines that the tax is rightfully due, you might have to pay the amount.

I hope this situation gets resolved in your favor soon. Remember, it's essential to stay proactive and keep pushing for a resolution.

Sir, refund amount of Rs.26650.00 was shifted to my account on 13.10.2022 for the ay 2022-23 as per 26 AS but the amont was not credited to my account till now. Matter was raised several times through grievence portal but still pending.pl suggest me what can i do now? I AM ALSO A SR. CITIZEN. PIJUSH KANTI PAUL, AGARTALA.
Ans: Many taxpayers are not able to claim refunds mainly due to 2 reasons

(1) Outstanding Tax Demand
(2) Issue in crediting refund in given bank account

Please check at income tax portal if any income tax demand is outstanding, check if bank accounts are properly validated. For Bank account validation, income tax department has asked to check following in news tab dated 13th Sep 2023.

Check Bank A/c validation Status For Refund.

Has your bank merged with another bank?

Has your bank branch changed?

Has your bank account number changed?

Has Your name in Bank Account changed?

Has your bank account closed or become inactive?

Has IFSC Code of your bank account changed?

IF YES….

You need to Update/ Revalidate your Bank A/c details on e-filing portal.

To update/revalidate your bank account details, login to: https://eportal.incometax.gov.in > Profile > My bank Accounts > Click on three vertical dots > Choose Revalidate>make required changes in data for updating details > Click on Validate button.

For adding a new bank account, login to https://eportal.incometax.gov.in > Profile > My bank Accounts > Add bank account > fill the required details > Click on Validate button.

After some time, you can check the status of bank account Validation.

Once the Status of Bank account changes to Validated, don’t forget to nominate it for refund by enabling the ‘Nominate for Refund’ button.

If the bank account validation has failed, you can remove that bank account by clicking on the three vertical dots on “My bank accounts” screen.

Please ensure that only those bank accounts, which are linked with PAN should be validated and nominated for refund. Refund cannot be credited to Bank A/c not linked with PAN.

What happens when a Mutual Fund company shuts down / gets sold off?
Ans: Hello;

If a mutual fund company gets sold or fails, the process is prescribed by SEBI:

In case MF company is Sold,
The new fund house may:
1. Continue the scheme with a new name and management.

2. Merge the scheme with similar funds and offer investors the option to exit without any exit load.

In case MF company shuts down,
The fund house will:
1. Pay out investors based on the fund's last recorded Net Asset Value (NAV) and the number of units the investor holds, after deducting expenses.

2. If the company is not in a position to do so then SEBI may liquidate the funds assets and distribute the proceeds to unit holders.

It is also pertinent to note that mutual fund regulation in India is one of the most stringent and hence best, from investor's point of view, globally.

This is not just in theory. We have seen how the Franklin Templeton abrupt closure of debt funds was handled with surgical precision, by SEBI, with no loss to unitholders.


Skin in the game regulation mandates that 20% salary of key mutual fund personnel and fund managers is paid in terms of units of their funds with a 3 year lock-in.

The stocks and bonds purchased by the AMC for the fund are held by a custodian, appointed by the trust that administers the fund.

The trust engages into a investment management agreement with the AMC for managing the fund as per their mandate and within regulatory guidelines.

Registrar and Transfer Agents handle the investor registration,kyc, maintaining records, providing account and tax statements etc.
