Hello, My CTC is 27 L. I own a flat (Co-owned by me and my Father). Home loan is closed so I cannot claim home loan interest benefit. Can I say that I pay 30,000 towards rent to my Father and claim HRA benefit? My Father is in lower tax bracket and he is fine with that. Is it right to do that? Will I have consequences later? I am doing this for tax saving. At present, I am paying approx. 40000 to 42000 Income tax monthly. Regards,

Ans: Rent can be paid to close relatives for use of property, but since you are the co-owner, this may not be a better tax planning for you.

1. Your father is required to file his return of income and disclose the rent received from you, as taxable income. Be informed that, out of rent, paid by you, the rent to the extent of your own portion of share in the property would be added to your income, the rent paid would be considered as total rent - attributable to to both owners of the property and the rent as per the percentage would be allocated to the concern co-owner.

There are other available tax planning modes, which may work better for you as under, some examples are as under,

1. Buying a house property and avail a home loan.

2. Buying an Electric Vehicle, additional deduction of Rs. 1.50 Lacs. / per annum.
