Sir During the process of correction mistakenly a new pan pop up came on my screen and I clicked it and OTP came I gave the OTP now I have been issued a new pan unknowingly. And also this new pan is linked with adhaar automatically. My orignal pan has become inoperative due to non linking with adhaar . I had gone to my jurisdiction officer he takes the application and does nothin since two years .I have also raised greviance on income tax portal they had asked me to give an affilidavit which I did six months back. Still nothing done. What can be done sir. I am unable to file my return as it is not allowing for verification after filing the return. And pertinent to mention that the new pan is having no transactions as it was mistakenly issued virtually. Request help

Ans: 01. File your ITRs regularly against old PAN. You can EVC through your bank accounts also, where old pan has been mentioned. Alternatively, you may forward ITR-V duly signed to Bangalore, after filing your ITR.
02. You may try the Option of visiting Aadhar Facilitation Center & request them to change your PAN linking with aadhar, by replacing your PAN number.

Hi I had used the services of ClearTax to file my tax returns for the financial year 2021-22. ClearTax had appointed a CA to be by point of contact and to file my taxes. Everything was going smooth and they had sent me the final filings (ITR-3) for me to approve and pay off the tax. I paid the tax and gave the go ahead to file my returns. They filed my returns on 31st July2022 and then I noticed by mistake the CA had filled someone else's returns (ITR - 1) with all wrong numbers also using in the old tax regime. I immediately got his attention and he said that it was busy time and by mistake he attached someone else's filings to mine. He immediately corrected the mistake on 2nd August and filed mine with the right details. I asked him multiple times if it will be a problem to which he clearly said nothing to worry. Fast-forward to February 2023 and I got a notice from IT department that since I had submitted my filings in old tax regime as on 31st July I have pay 85K + additional tax. I have taken up to the clear tax team and they are making us run around in circles. Now the latest is the clear tax team has filled a grievance with the AO. My questions is any chance that it will be reversed as along clear tax team has been saying its not our fault don't worry everything will be ok. They are just making us run around. Do you think I will get my money back

Regarding the notice from the IT department, the fact that you've received a notice means that the department has identified a discrepancy in your filings. The grievance filed with the Assessing Officer (AO) by ClearTax is a step in the right direction. The AO is responsible for assessing and reassessing income, and they have the authority to rectify any mistakes.

Given that you have evidence of the mistake and its rectification, there's a good chance that the AO will consider your grievance. However, the process might take some time, and there's no guarantee of the outcome. It's essential to keep all communication and documentation related to this issue handy.

As for getting your money back, if the AO acknowledges the mistake and rectifies it, you might be eligible for a refund. However, if the AO determines that the tax is rightfully due, you might have to pay the amount.

I hope this situation gets resolved in your favor soon. Remember, it's essential to stay proactive and keep pushing for a resolution.

My querry is income taxrelated . I am under zero tax liability. I am a housewife. Earlier about twenty year back , I applied for PAN card and for the first year filed IT return with income of about 1 lacs from petty jobs ( like stictching, tuition etc.). After that I never filed return. But I was investing in mutual fund. In A.Y. 2021-22, I had divided income of about 38000/- in which TDS was deducted. To get the refund, I filed IT return showing income of rs. 38,000/- FROM MF dividend and I got the refund. In A.Y. 2022-23, I did not filed return . for A.Y. 2023-24, I filed for 4.5 lacs and for A.Y. 2024-25, I filed IT return for 4.88 lacs and tax liability was zero. for both the year source of income was indicated as: income from other sources, (sticting, tuition etc). Now a few days ago, I received email for IT department: please file updated return for A.Y. 2022-23." I tried using utility form. Filing updated return will attract a fee of rs. 1000/-. Is it necessary to file updated return for A.Y. 2022-23. If I do not file the updated return, what are the complications.
Ans: 01. First of all, kindly confirm what was your Income during A/Y 2022-23.
02. If this income was less than Rs.2,50,000.00, you may not file your ITR.
03. If your income during this period was more than Rs.2,50,000.00, it is mandatory for you to file your ITR.
04. You may file Updated ITR, if para no.3 above is applicable in your case.
05. Otherwise write to IT Department that your income was below minimum taxable limit, as such you are not required to file ITR. In this case, you are not required to take any action on the mail of department.
