sir. Is Apartment /Flat is treated as residential property or site used for construction of the House is residential property to avoid LTCG tax.

Ans: In Sec 54, to claim exemption assessee claim exemption if "cost of the residential house so purchased or constructed" is more than long term capital gain earned. Thus, site (land cost) will also be considered as cost of residential house. However, it can be subject to litigation.
