Question: I am an NRI retail investor. I purchased 3,651 shares of a stock in my NRI PINS account, which subsequently underwent a 1-to-1 bonus issue, mathematically halving the stock price. I liquidated the entire holding on the same day to recover my capital. My actual net economic profit across the complete lifecycle was a mere ₹2,884.29. However, because my original buy and the subsequent bonus sales occurred across decoupled accounts managed by the same broker (ICICI Direct), their system completely blanketed my initial purchase transaction. They treated the bonus shares, sold in my NON PINS account as "zero cost" in complete isolation, calculated an artificial short-term capital gain of ₹80,322, and locked up ₹19,213.02 in TDS—which is seven times my actual profit! As independent experts, is it legally permissible for an intermediary to enforce punitive tax withholdings solely because their internal software suffers from a technical gap and cannot track a client's unified ledger? What recourse do I have when the broker's system blindness creates an artificial financial loss on paper?

Ans: Your concern is valid from an economic perspective.
A bonus issue does not create immediate wealth.
After a 1:1 bonus issue, the share count doubles.
At the same time, the market price adjusts downward.
Therefore, your overall investment value broadly remains unchanged.
Based on your explanation, your actual economic gain was only around Rs.2,884.
However, the tax reporting appears to have treated the bonus shares separately.
This resulted in a much larger notional gain being reported.

» What the Tax Law Says

Under Indian tax law, bonus shares are generally allotted at a cost of acquisition of Nil.
When bonus shares are sold, the sale proceeds minus the prescribed cost become taxable capital gains.
This treatment applies irrespective of whether there was an economic gain from the overall investment cycle.
At the same time, the original shares continue to retain their original purchase cost.
Therefore, tax computation should ideally consider both transactions correctly.
The original shares sold should get the benefit of their actual acquisition cost.
The bonus shares should be treated according to the bonus share tax rules.

» Role of the Broker

A broker is generally responsible for reporting transactions and deducting applicable TDS where required.
For NRI investors, brokers and custodians often apply TDS based on transaction-level tax calculations.
In many cases, they rely on the records available within the account from which the sale occurs.
If shares were transferred between PINS and Non-PINS accounts, or between different demat segments, system limitations can sometimes arise.
However, a software limitation does not change the actual tax position under the law.
Tax liability is determined by tax provisions, not by software architecture.

» Can a Broker Legally Deduct TDS Based on Its Records?

In practice, brokers often deduct TDS based on the information available to them.
The deduction itself may not necessarily determine your final tax liability.
TDS is only a tax withholding mechanism.
It is not the final tax assessment.
Therefore, even if excess TDS has been deducted, the final tax computation can still be corrected while filing the income tax return.

» Important Point to Verify

The key question is whether the original shares were also sold.
If yes, how were they reported?
Was the acquisition cost of the original 3,651 shares properly captured?
Did the broker report two separate sale transactions?
Was the bonus allotment reflected correctly in the demat records?
The answers to these questions will determine whether the reported gain is genuinely incorrect or merely incomplete.

» Possible Recourse

First, obtain a complete contract note and capital gains statement.
Obtain the demat transaction statement showing:
Original purchase.
Bonus allotment.
Transfer between PINS and Non-PINS accounts.
Final sale.
Submit a written grievance to the broker's compliance department.
Request a revised capital gains computation.
Ask them to explain the exact basis of the Rs.80,322 gain calculation.
If the response is unsatisfactory, escalate the matter through the broker's formal grievance process.
You may also raise the issue with the relevant investor grievance mechanism of the stock market ecosystem if you believe reporting errors have occurred.

» Tax Return Stage

Even if excess TDS has been deducted, you may still claim credit for the TDS appearing in your tax records.
Your actual capital gains can be computed independently based on tax law and supporting documents.
If the final tax liability is lower than the TDS deducted, the excess amount may become refundable upon assessment of your return.

» Practical Assessment

From what you have described, there appears to be a difference between:
Economic profit of the entire investment cycle.
Tax treatment of bonus shares under the Income-tax Act.
Broker-level transaction reporting.
These three figures are often not identical.
Therefore, before concluding that the Rs.80,322 gain is entirely incorrect, it is important to reconstruct the exact tax computation transaction by transaction.

» Final Insights

A broker's software limitation should not determine your final tax liability.
TDS deduction is not the same as final tax payable.
The most important step is to obtain the complete transaction trail and verify how the original shares, bonus shares and sale proceeds were reported.
If the gain has genuinely been overstated due to account segregation or reporting errors, you have grounds to seek correction through the broker's compliance process and subsequently claim the correct tax treatment in your income tax return.

Please provide correct advice in the following situation. We filed ROI for AY 2019-20 on 30-10-2019 and paid a tax amount of Rs 1,20,03,465/- under section 115JB. Above return was processed u/s 143 (1) by intimation dated 19-05-2020. The Company has deposited Advance tax of Rs. 40, 00,000/- and ITR -6 for AY 2019-20 was filed under Section 139 on 30-10-2019 to obviate any violation in Tax compliance including the TDS claim of Rs. 87,29,484/-. In the Intimation order the assessing officer had accepted the income and other claims of the Appellant but had demanded Rs 97,85,148/- as balance tax and interest. During the Assessment Year relevant to Previous Year 2018-19, the land under the ownership of the Assessee has been taken over by the Government for Guruvayur Dewaswam (GD). LA compensation of Rs.38565360/- (on 5- 2-2018), Rs.4,00,00,000/- (on 4-2-2019), and Rs.48,28,009/- on19-11-2020 were paid to the Petitioner Company. Deductor, GD did not deposit the TDS to government in relevant years, this resulted in the demand of Rs. 97,85,148/- on Company towards balance tax and interest in the intimation u/s 143 (1) dated 19-05-2020. GD deposited Rs.95,02,088 /- towards TDS and Rs.21, 25,421 /-towards TDS and interest on 30-1-2021 and filed TDS return for the Assessment Year 2021-22. (not AY 2019-20). Deductor is delaying filing revised TDS return in spite of many requests even by Income tax authorities. Can the Income tax department seek to recover Income tax with fine from Company for AY 2019-20, on mere fact that Petitioner could not account for deposit of such tax (TDS) (Rs.87,29,484/-, only because the deductor, after paying the compensation to Petitioner in relevant year, did not deposit TDS to government revenue? Should the assessee suffer for the fault of the deductor? We understand There is a bar under Section 205 and circular of CBDT in this matter.
Ans: If TDS is deducted and there was delay in depositing TDS, said TDS amount cannot be recovered from deductee. There are some judicial pronouncements for the same which provides relief to taxpayer (deductee). But in given case, I understand that it is not case of delay but amount credited in different year.

In such a case, you can request to jurisdictional officer to provide credit of TDS in the year in which income is offered to tax though TDS is appearing in 26AS of subsequent year and it can be subject to litigation.

Money
Dear Sir, I want advice from Tax Expert Date of deal 20th March 2025. Amount- Rs. 90,00000/- (2 Sellers – 1st party is husband and 2nd party is wife) 1% TDS deducted, 0.5 percent deposited same day in husband(1ST Party) PAN account (Amount:- Rs.45,500/- ,Date:- 20/03/2025) , 0.5 percent could not be deposited in wife (2Nd Party) PAN account due to inactive PAN. Sellers were non cooperative. After so many requests and follow up they linked PAN with Aadhar in Dec 2025 and I have deposited the remaining 0.5 percent along with interest and penalty Amount:- Rs.97825/- , Date:- 14/12/2025 ). After 02 days I received demand notice for 20% TDS + interest + huge penalty (Amount- Rs.9,53,655/-). Question:- I am facing difficulties(20% TDS + interest + huge penalty) due to the seller’s mistake. Despite making multiple requests to have their PAN card activated, their negligence has resulted in ongoing problems for me. Requirements:- I request that the demand of Rs. 9,53,655/- be cancelled, or alternatively, that any applicable penalty be recovered from the seller. The issue arose solely due to the seller’s failure to keep their PAN card active, which caused difficulties in depositing TDS. I have fully complied with all my obligations and repeatedly requested the seller, from time to time, to activate their PAN card; however, the seller did not pay due attention to this matter. Since the lapse was entirely on the seller’s part, I respectfully request that the said demand be cancelled. I kindly request you to please suggest a possible way to resolve this issue.
Ans: There has been cases where this issue is resolved with proper paperwork and getting things done as required.
You need to consult CA, who will guide you the further process

Dating, Relationships Expert - Answered on Aug 13, 2026

Relationship
Hi, I am 58 Yr old Male with 29 yrs into arranged marriage. I have 2 daughters. I am being treated like a stranger in my own house. My wife does not give respect, no value, no love and affection care. Always negatives talking about me for everything. Not listen to any thing regarding family or personal matters. I am not earning much. I am doing my best doing business services. For everything I need basic amount to manage my business until it develops. There is no support for this from my family. Instead of supporting and motivating me, She is always negative about me. She knows I am not earning enough and unable to meet major transactions. She has come from a wealthy family were as I am not. She has helped in providing financial support many times. Now past 3-4 yrs, her behavior has changed. She taunts and blames me for she providing the financial support. Whatever she has provided is always used for family. she knows that. I am unable to focus on my business development. She's gives negative feedback about me to my daughters and they also behave same with me, Instead of supporting and motivating me. There is no intimacy or sex past 1 year. Hardly 1 once in a month earlier, after I force (make positive effort) her lovingly. I love her very much. But this is making me lose that love & affection on her. In our 29 yrs of marriage, she never initiated intimacy, love. Always I been doing it. She never shows interest in getting physical right from 1st day. She has not kissed me even once or hugged me voluntarily in these 29 yrs. I initiate everything. I am romantic. She is not. She gives one or the other reason and avoids. She avoids kissing. She never liked gifts i bought for her. I want her to wear different dresses, but she rejects. Though we sleep on same bed, she just sleeps off. When i go to her, either she pushes or says she has to wake up early sleep now. Even with so many days gap, when I initiate intimacy after 1-3 months, but she taunts saying I only want that from her. I have been hugging, kissing and showing love, affection care on her right from the 1st day of marriage. The same thing is missing from her. I have tried many times talking to her in polite way, trying to woo her, but of no use. I have approached many times we can have one on one talk and sort out any issues she has with me, but she avoids coming into talking terms. I have tried to talk saying lets understand whats going wrong. If I start generally talking, she starts arguing, negative talking and avoids the main discussion that forces me to shut my mouth. when we go out on a 2-3 day trip, she enjoys outing seeing places, food & sleep. Doesn't behave romantically, lovingly. It's just like same as at home. Even I know I am not earning much and trying best to do well. She always keep telling about her money and financial support and her parental house with arrogance & attitude. She has been good with her parental side, but not my side. I believe both husband and wife should take care of family together irrespective of who is more financially strong. Just because I am not earning well, this type of treatment I don't understand. If it was recent few yrs I can understand. But right from day one I have been facing this. Now I've stopped talking much and in silence going through loneliness.
Ans: Dear Prashanth,
I understand that it has been quite difficult for you. After 29 yrs, feeling unwanted, unsupported and criticized can leave anyone extremely lonely. Your problem sounds a lot bigger than just lack of intimacy. There are long-standing communication issues, and both emotional and financial issues. This cannot be solved with romance alone. The better step is to stop pursuing intimacy for now, since your partner is uninterested, and instead focus on having a structured conversation, such as, "Are you willing to work on this marriage, to make it better?" If she refuses to discuss these things with you, I suggest seeing a marriage counsellor; it will be an impartial party looking into the matter, without supporting one over another.

Hope this helps.

Career Counsellor - Answered on Aug 12, 2026

Asked by Anonymous - Aug 12, 2026
Career
my daughter has secured admission in CSE-AI at IGDTUW .Going by the reputation of the institute she withdrew from BITSAT,JOSAA, LNMIIT and MHT-CET counselings. But now after attending the college for few days, she has been completely put off by the real bad infra and attitude of teachers there.Only viable option left now for her is COMEDK, where she can get CSE in MSRIT.We are delhi based and budget is not a issue. Please suggest further course of action.
Ans: Your daughter may consider switching to MSRIT CSE through COMEDK if her initial experience at IGDTUW has led her to reassess her choice. MSRIT offers good industry exposure and the advantage of Bengaluru’s strong technology ecosystem. However, it would be advisable to visit MSRIT and interact with current students before making the final decision.

Please also verify the current COMEDK counselling and reporting status, as deadlines and eligibility can vary by round. Before proceeding, confirm that her specific counselling status permits admission/reporting at MSRIT.

At the same time, it is important to remember that no institution is perfect; every college has its own strengths and areas for improvement. The decision should therefore consider academics, campus environment, faculty interaction, placements, peer group, location and overall student experience.

Finally, ensure that your daughter is comfortable and mentally prepared to relocate from Delhi to Bengaluru, and that you as parents are also equally comfortable with the transition. If MSRIT appears to offer a better overall fit after this evaluation, switching can be a reasonable option. If possible, it may be worthwhile to keep RVCE CSE as a preference until the final counselling round, provided your daughter has already included RVCE CSE among her choices. If the option remains available in the subsequent rounds, she can consider it based on the seat availability and her merit position. All The Best for Your Daughter's Prosperous Future!
