I purchased a flat in Pune @ 42 Lakhs and selling the same @ 31 Lakhs. Can I claim any Tax benefit on the loss incurred Rajan

Ans: 01. If this is a LTC Loss, then it can be adjusted against LTCG (if any).
02. If it is STC Loss, it can be adjusted with STCG/LTCG, if any.
03. If there is no LTCG or STCG during the year, this loss can be carried forward, for any adjustments against these heads in future up to 8 years.
04. Please note that ITR Filing in time is mandatory for carry forward of loss.

मैंने हैदराबाद में अपना फ्लैट 25 लाख रुपये में बेचा है, 7 टीआरएस से पहले का फ्लैट 13 लाख में खरीदा था मैं कर क्षेत्र में नहीं हूं और 10 साल से आईटीआर जमा कर रहा हूं, क्या मैं पूंजीगत लाभ पर कर से बच सकता हूं?

Ans: आवासीय संपत्ति के हस्तांतरण से वर्ष के दौरान अर्जित पूंजीगत लाभ पर कर छूट का दावा करने के लिए, आपको लाभ राशि को 3 साल के भीतर नई गृह संपत्ति में निवेश करना होगा (यदि आप नई संपत्ति बनाने की योजना बना रहे हैं) या एक या दो साल की अवधि के भीतर पुराने घर के हस्तांतरण की तारीख के वर्षों बाद, आपको दूसरा आवासीय घर लेना चाहिए।

मैंने जनवरी 2005 में पुणे में 12 लाख में फ्लैट खरीदा था। मैंने जून 2024 में फ्लैट 61 लाख में बेचा। मेरा कैपिटल टैक्स गेन कितना है। क्या मैं अपने कैपिटल गेन लॉस को एडजस्ट कर सकता हूँ जो 2021-22 से आगे बढ़ रहा है जो लगभग 23 लाख है।

Ans: नमस्ते
अनुमानित दीर्घकालीन पूंजीगत लाभ लगभग 22.45 लाख रुपये होगा। घाटे को आगे ले जाने की सभी शर्तों को पूरा करने के अधीन, आगे लाए गए 23 लाख रुपये के नुकसान को दीर्घकालीन पूंजीगत लाभ के विरुद्ध सेट किया जा सकता है।
